TRIBUNAL DISMISSES PETITION AGAINST SUSWAM

The National and State Assembly Elections Petition Tribunal sitting in Makurdi has dismissed the petition filed against Rt Honourable Senator Gabriel Suswam, by the defeated candidate of the All Progressives Congress, Mimi Adzape Orubibi challenging the victory of the senator.

In a judgement that lasted for three hours, the Tribunal chairman declared that the petition was not just incompetent and lacking in merit but a waste of precious time of the Tribunal and consequently awarded the cost of Four Hundred Thousand Naira, to be paid by the petitioner to each of the respondents.

The chairman held that the Tribunal could not abandon her duties and go in search of irregularities in the documents dumped at the tribunal maintaining that the petitioner having alleged had to carry the heavy burden to proof her allegations.

Mimi who approached the tribunal challenging the victory of Senator Suswam alleged that there were over voting, harassment of APC supporters, vote buying, amongst other irregularities but could not prove her case before the tribunal. 

Counsel to Senator Suswam, Andrew Wombo, said the judgement was very sound and based on the principles of law maintaining that it will stand the taste of time.

In his reaction, Chief Francis Nomor, counsel to the petitioner promised to test the the judgement at the appellant Court.
